The petitioner seeks bail in connection with Kadamkuan Police Station Case No.381 of 2015 registered under Sections 363 and 365 of the Indian Penal Code.
The accusation against the petitioner is of kidnapping Priti Kumari, aged about 24 years, the daughter of the informant Ramsewak Prasad.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the statement of the victim recorded under Section 164 of the Code of Criminal Procedure on 17.08.2015 that the victim has stated therein that she reached her
Patna High Court Cr.Misc. No.9170 of 2016 (2) dt.29-03-2016 2/2 house on foot after getting down from the train at Patna and she has also stated therein about her kidnapping by this petitioner on giving assurance of performing the marriage with her and providing the job. The victim also disclosed her age as 24 years in her statement recorded under Section 164 of the Code of Criminal Procedure. In fact, there was love affair in between the petitioner and the victim but due to ulterior motive, the petitioner has falsely been implicated in this case. The petitioner is in custody since 26.08.2015.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna, in connection with Kadamkuan Police Station Case No.381 of 2015.
