JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-01-2020 Petitioner seeks bail in anticipation of her arrest in connection with Giriyak P.S. Case No. 130 of 2019 registered for the offences punishable under Sections 341, 323, 302 and 504/34 of the Indian Penal Code.

Prosecution case is that petitioner and other accused persons came variously armed and started abusing wife of the informant and there is specific allegation against one Santosh Tanti that he handed over Pata to Lalan Tanti and gave order to kill the wife of informant, on which he assaulted her causing injury and she became unconscious and later on died. Submission of learned counsel for the petitioner is that petitioner is lady and she has falsely been implicated in this case and no specific overt act has been mentioned against her. Heard learned APP also.

No.58613 of 2019(4) dt.08-01-2020 2/2 In view of above facts and circumstances, let petitioner, in the event of surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Nalanda at Biharsharif, in connection with Giriyak P.S. Case No. 130 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
