The petitioner apprehends his arrest in a case registered for the offence under Section of the Indian Penal Code.

As per the prosecution case, 82 liters & 980 ml. of illicit liquor has been recovered a car, which is said to be registered in the name of petitioner.

It is submitted on behalf of petitioner that petitioner is not owner of the said car and in support of the same, he has annexed Annexure - 2, which is photocopy of the registration certificate of vehicle in question, issued from Jharkhand State wherein details of owner is stated as Uma Shankar Singh, S/o Ramayan Singh, Katras Road, Vikash Nagarm Matkuria Dhanbad.

No.62239 of 2022(2) dt.09-12-2022 2/2 In view of aforesaid facts and circumstances, the present petition is disposed of with direction to the learned court below to verify the ownership of the vehicle in question and if after verifying the same, it is found that petitioner is not registered owner of the said vehicle, he (petitioner) shall be enlarged on anticipatory bail by the learned court below, on such terms and conditions, as it deem fit and proper in the facts and circumstances of cases.
