JUSTICE BIRENDRA KUMAR ORAL ORDER 01-07-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 341, 342, 498A, 447, 448, 307, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

This is a case under Section 498A of the Indian Penal Code. The petitioners are parents of the husband. The anticipatory bail application of the husband is pending before a coordinate Bench of this Court in Cr. Misc. No.26313 of 2017. Submission is that the complainant has entered into

Patna High Court Cr.Misc. No.24772 of 2017 (2) dt.01-07-2017 2/2 compromise with the husband vide Annexure-3, which was filed before the learned Principal Judge, Family Court. The allegation is general and omnibus.

Considering the aforesaid submission, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria/Successor Court in connection with Complaint Case No.181C of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioners shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioners in this case.
