The petitioner is languishing in custody since 18.10.2014 in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

Informant's Bajaj Platina motorcycle was stolen away. Subsequently two motorcycles were recovered in connection with Phulwarisharif P.S. Case No. 530 of 2014. One Honda Dream motorcycle was recovered from the petitioner whereas other Bajaj Platina of different registration number has been recovered from co-accused Birendra Kumar. It is submitted by learned counsel for the petitioner that the informant's stolen motorcycle was not

Patna High Court Cr.Misc. No.5840 of 2015 (02) dt.12-03-2015 2/2 recovered from the possession of the petitioner and the petitioner is accused in two other cases in which he is on bail. The seizure list prepared in Phulwarisharif P.S. Case No. 530 of 2014 has been brought on record as Annexure-2.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Kotwali P.S. Case No. 498 of 2014. The learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
