NILU AGRAWAL ORAL JUDGMENT Date : 04-12-2018 Heard learned counsel for the petitioner, learned counsel for the State, counsel for the Bihar State Food and Civil Supplies Corporation Ltd.(hereinafter referred to as the BSFC) and learned counsel appearing for the respondent-Bhumi Vikas Bank (hereinafter referred to as the Bank).

2. A cheque of Rs. 4,61,450/- drawn on Canara Bank being Cheque No. 734963 dated 25.11.2018 has been produced in

Patna High Court CWJC No.3245 of 2018 dt.04-12-2018 2/2 Court regarding arrears of salary from June, 2014 to March, 2016. The same is handed over to the counsel for the petitioner.

3. It has been submitted by the learned counsel for the petitioner that the period petitioner worked in the BSFC was between 25.08.2009 till his retirement i.e. 31.03.2016 but the EPF deducted between 31.08.2012 to 31.05.2014 has not been sent to the Bank or the office of the EPF, Patna.

4. Considering the nature of prayer made by the petitioner, let petitioner file a representation before respondent no. 11, the District Manager, BSFC, Munger, who will pass a speaking order within a period of two months from the date of receipt of the representation of the petitioner and the amount shall be credited in the Bank or the office of EPF, Patna within the same time if the same has been deducted in the account of EPF/ Bank.

5. Writ application is, accordingly, disposed of.

6. Counsel for the petitioner would give receiving regarding receipt of the aforesaid cheque.
