JUSTICE BIRENDRA KUMAR ORAL ORDER 06-07-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 363/366A/34 of the Indian Penal Code. Subsequently, Section 4 of the POCSO Act was added.

There is allegation of kidnapping of Ladli Praveen, the minor daughter of the informant, by the petitioners. Submission is that Ladli Parveen has already married with petitioner Md. Chhotu and a compromise petition has already been filed in the learned court-below.

No.24804 of 2017 (2) dt.06-07-2017 2/2 Considering the aforesaid factual position, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur/Successor Court in connection with Kalyanpur Police Station Case No.105 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioners shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioners in this case.
