JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT (Per: HONOURABLE THE ACTING CHIEF JUSTICE) Date: 23-11-2016 The present is the application for review of the order dated 13th March, 2014 passed by the Division Bench of this Court in LPA No. 238 of 2012 whereby, the letters patent appeal was dismissed affirming the order passed by the learned Single Bench dated 2nd January, 2012.
2. The learned Single Bench has given detailed and cogent reason as to why the order of the District Teachers
Patna High Court C. REV. No.46 of 2015 dt.23-11-2016 2/2 Employment Appellate Authority does not warrant any interference. It has been found that no proper procedure in terms of the rules had been followed in such recruitment. Opportunity for raising objections and information has not been given. The so called communication made by the Panchayat Secretary does not inspire confidence. The Appellate Authority passed an order finding loopholes in the mechanism leading to appointments of the Panchayat Teachers including that of the petitioner. Therefore, the learned Single Bench maintained the order of the Appellate Authority. Such order has not been interfered with in the Letters Patent Appeal.
3. We do not find any error apparent on the record which may warrant review of the order. In fact under the garb of review, learned Counsel for the petitioner wishes to reargue the entire matter.
