====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 12-10-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Kanhauli P.S. Case No. 159 of 2018 dated 23.12.2018 registered for the offence punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

3. As per the prosecution case, some miscreants are alleged to have assembled and are making preparation to commit crime and four miscreants were apprehended by police. On search, country made pistol, live cartridges etc., were recovered from possession of the apprehended miscreants and the apprehended miscreants disclosed the name of the petitioner

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has seven criminal antecedents, as stated in paragraph no. 3 of the bail petition. It is further submitted that the petitioner is not named in the F.I.R. and his name has been disclosed by the apprehended co-accused persons, namely, Munna Khan, Gautam Choudhary, Kundan Kumar and Mandan Kumar. Nothing has been recovered from his conscious possession. The petitioner has been arrested in Runnisaidpur P.S. Case No. 162 of 2021 on 12.03.2021 and he has been remanded in the present case on 18.01.2023 since then he is in judicial custody. Other co-accused persons have been granted bail by the then different Co-ordinate Benches of this Court vide Cr. Misc. No. 13431 of 2019 under order dated 07.03.2019, Cr. Misc. No. 19793 of 2019 under order dated 02.04.2019, Cr. Misc. No. 24401 of 2019 under order dated 16.04.2019 and Cr. Misc. No. 24534 of 2019 under order dated 16.04.2019.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.64805 of 2023(2) dt.12-10-2023 3/3 of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court concerned, Sitamarhi, in connection with Kanhauli P.S. Case No. 159 of 2018 with the condition:- (I) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
