The petitioners have prayed for grant of bail in connection with Majorganj P.S. Case No. 84 of 2023 registered under sections 302, 201, 120B and 34 of the Indian Penal Code. As per the FIR, allegation against co-accused, namely, Kanhai Singh is that he fired from his pistol to one Anmol Raj due to which he sustained gun shot injury and later on he died during the course of treatment. Allegation against these petitioners is that they also involved in this offence. Learned counsel for the petitioners submits that the petitioner are innocent and have committed no offence. They

No any specific overt act of firing against these petitioners rather the specific allegation of firing upon the deceased is against co-accused, namely, Kanhai Singh. Nothing consistent material has come against these petitioners. Moreover, they are languishing in judicial custody since 15.07.2023.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of this case as well as the custody of the petitioners, the Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail in connection with Majorganj P.S. Case No. 84 of 2023 on each of them furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Sitamarhi.
