JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 147, 148, 149, 307, 379 and 435 of the Indian Penal Code.
It is specifically alleged that the petitioner assaulted with Farsa on the head of informant.
It is submitted by the learned counsel for the petitioner that the informant has received five injuries out of which four have been found as abrasions and one as lacerated one on forehead simple in nature caused by hard and blunt substance. The accusation has been levelled in the background of the fact that the informant side has encroached upon the land of mosque but the Appellate Authority has decided the issue in favour of petitioner's
Patna High Court Cr.Misc. No.7172 of 2016 (2) dt.17-02-2016 2/2 side. The petitioner is old person aged about 72 years. Considering the aforesaid facts and the fact that accusation is not corroborated by medical opinion, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhagalpur in connection with Kahalgaon P.S. Case No. 215 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
