2. The petitioners have prayed for regular bail in a case registered for the offence punishable under sections 126(2), 115 (2), 118(1), 109, 351 (2), 352 and 3 (5) of the BNS.
3. The case of the prosecution, in short, is that the petitioner no.1 is alleged to have assaulted the informant with a 'knife' on his neck. However, the informant tried to save the said blow, the same is said to have hit on his forehead. So far as petitioner no. 2 is concerned, it is alleged that as the nephew of the informant came to rescue him, petitioner no.2, namely, Suresh Rai started assaulting him by jumping upon his chest.
4. Learned counsel for the petitioners submits that the petitioners ar innocent and have falsely been implicated in
Patna High Court CR. MISC. No.61941 of 2025(2) dt.10-09-2025 2/2 connection with the present case. It is further submitted that there is also a counter version of this case which has been filed prior to the present case. It is further submitted that on perusal of the injury report, which is annexed as P/3 to the petition, the nature of injury which has been received by the informant is simple in nature caused by hard and blunt substance. So far as injury of Kaushal Kumar is concerned, the same has also been opined to be simple in nature. Moreover, the petitioner is languishing in judicial custody since 27.07.2025 having no criminal antecedent.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Doriganj P.S. Case No. 280 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Saran at Chapra.
