JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-03-2015 Heard learned counsel for the petitioner and the State. The petitioner being brother of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 302/201/34 of the Indian Penal Code.

The accusation is of killing the daughter of the informant after 10 years of marriage for non-fulfillment of dowry demand.

It is submitted by learned counsel for the petitioner that husband and father-in-law of the victim, after facing trial in Sessions Trial No.264 of 2014, have been acquitted as the accusation has not been supported by the prosecution witnesses, particularly, the informant. Investigation against the petitioner is still pending and the informant has retracted from initial

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Chandi P.S.
