Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Sigori P.S. Case No. 45 of 2021 lodged under Sections 304(B)/201/34 of the I.P.C.
As per the prosecution case, the allegation of dowry death is there in the F.I.R.
Learned counsel for the petitioner submits that petitioner is the husband. Counsel submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 24.02.2022 by way of surrendering himself. He submits that petitioner is having clean antecedent.
Patna High Court CR. MISC. No.62891 of 2022(2) dt.25-02-2023 2/2 Counsel submits that under unfortunate circumstances, this occurrence took place. He also submits that this case has already been committed to the Session Court.
Learned counsel for the State opposes the prayer for bail and submits that petitioner is the husband and it is a case under Sections 304(B)/34 of the I.P.C.
In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner.
With this observation, the bail application stands rejected.
Trial court is directed to expedite the trial within nine months from today.
