The petitioner is accused in connection with Araria P.S. Case No. 639 of 2015, registered under Section 394 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the F.I.R. The name of the petitioner has been disclosed by co-accused Md. Shamin in his confessional statement as detailed in para 82 of the case diary showing the involvement of the petitioner and others in the present case, except that there is nothing against the petitioner. Sayem Ahsani has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 03.03.2016 passed in Criminal Misc. No. 10333 of 2016. The petitioner is in custody since 09.01.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 639 of 2015.
