The petitioner apprehends his arrest in a case under Section 302 and other Sections of the Indian Penal Code. The petitioner made 2nd attempt for grant of prearrest bail. It is submitted that the case was lodged in the year 2013 and his prayer for anticipatory bail was earlier rejected only on the ground that the petitioner moved for anticipatory bail in the year 2014. The anticipatory bail petition was not disposed of on merit but it appears that since the prayer for anticipatory bail has already been rejected, I am not inclined to take different view and consider the anticipatory bail petition afresh. Accordingly, the same is rejected in connection with

Patna High Court Cr.Misc. No.9521 of 2016 (6) dt.14-07-2016 2/2 Tariyani Chowk P.S. Case No.25 of 2013 pending in the court of Chief Judicial Magistrate, Sheohar. If the petitioner surrenders in the court below, the learned court below shall consider the prayer for regular bail of the petitioner without being prejudiced by this order.
