JUSTICE RAKESH KUMAR ORAL ORDER 10-08-2017 Heard Sri Ajay Kumar Sharma, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Jadopur P.S. Case No.24/2017 registered for the offence under Sections 272/ 273/420 of the Indian Penal Code and Sections 30(a) (b)(c)/35 of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail, in the event of his arrest or surrender.

At the very outset, it was submitted by learned counsel for the petitioner that nothing was recovered from the conscious possession of the petitioner. However, it was alleged that in a bush about six liters of country made liquor was concealed and maliciously the petitioner has been made

Patna High Court Cr.Misc. No.25086 of 2017 (3) dt.10-08-2017 2/2 accused by the officer Incharge , against whom earlier cousin of the petitioner had filed a complaint.

Considering the facts and circumstances let the petitioner, namely, Bechu Sah @ Bechu Mahto , in the event of his arrest or surrender within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge-cum-2nd Addl. Sessions Judge, Gopalganj in connection with Jadopur P.S. Case No.24/2017 , subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
