JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 07-07-2017 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioners apprehend their arrest in connection with Jhajha P.S. Case No. 145 of 2016 for the offences punishable under sections 147, 148, 149, 341, 323, 325, 307, 504 and 506 of the I.P.C. Allegedly, the petitioners and others altogether 14 accused persons assaulted the informant causing injury on his head and when Dhaneshwar Yadav came for rescue he was also assaulted by them on the head and left leg and both hands of the

Patna High Court Cr.Misc. No.26429 of 2017 (2) dt.07-07-2017 2/2 informant has been fractured.

Submission is of false implication and that there is no specific allegation against the petitioners, the allegations are omnibus and general in nature, there is case and counter case, admittedly the occurrence has taken place due to the land dispute, Dhaneshwar Yadav has received three injuries which all are simple in nature caused by hard and blunt substance, whereas, the informant has received one grievous injury which is fracture of right ulna lower end, no injury has been found on the vital part and as such the petitioners deserve sympathetic consideration. The learned A.P.P. opposes prayer for pre-arrest bail of the petitioners.

In the facts and circumstances as stated above, the petitioners, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. S.D.J.M. Jamui in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
