2. The present modification application has been filed for modify the order dated 13.12.2023 passed in Cr. Misc. No. 55104 of 2023.
3. Learned counsel for the petitioner submits that due to communication gap the petitioner could not surrender within the stipulated time as directed by order dated 13.12.2023. Learned counsel for the petitioner has produced a demand draft of Rs. 1,00,000/- dated 29.11.2024 in favour of the informant namely Daymanti Devi, the reason mentioned in the
Patna High Court CR. MISC. No.75259 of 2024(3) dt.29-11-2024 2/3 modification application.
4. Accordingly, the order dated 13.12.2023 is modified.
5. In this view of the matter, the time granted for surrender before the learned Court below in terms of order dated 13.12.2023 in Cr. Misc. No. 55104 of 2023 is extended by three weeks from today with the following conditions : (i) At the time of furnishing bail bond, the petitioner shall produce a demand draft of Rs 1,00,000/- dated 29.11.2024 bearing no. 219269 which was issued in favour of the informant namely Daymanti Devi and the learned Court below is directed to hand over the same to the informant or her representative. (ii) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below. (iii) If the petitioner tampers with the evidence or the witness, in that case, the prosecution will be at liberty to move for cancellation of bail.
(iv) And, further condition that the court below shall verify the criminal antecedent of the petitioner and in case at
Patna High Court CR. MISC. No.75259 of 2024(3) dt.29-11-2024 3/3 any stage, it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
