JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-03-2016 Heard learned counsels for the petitioner and the State.
The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code and 25(1-B)a, 26, 35 of the Arms Act. On secret information that miscreants are preparing to commit 'dacoiti', a raid was laid when Tashbur Ansari, Anil Sharma, Ranjit Yadav Balmiki @ Balmukund Yadav and Talo Soren were apprehend and from their possession arms and mobiles were recovered. The apprehended accused persons disclosed the name of Jogi @ Goendra Yadav, Surendra Yadav, Lalu Yadav, Bijay Yadav and Ramdeo Yadav (the petitioner), as the persons who escaped from the scene.
It is submitted by learned counsel for the petitioner
Patna High Court Cr.Misc. No.9427 of 2016 (2) dt.01-03-2016 2/2 that except the confession of co-accused nothing has been collected, against the petitioner, during investigation by the investigating agency and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the fact that similarly situated accused persons have been granted regular bail vide Criminal Miscellaneous Nos.5084/2016 and 5293/2016, this Court is not inclined to grant anticipatory bail to the petitioner. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Jhajha P.S. Case No.206/2015, pending before the learned SDJM, Jamui. With the above observation, this application is, accordingly, disposed off.
