1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 191(2), 190, 76, 109, 303(2), 352, 351 and 329(4) of the B.N.S.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that petitioner parked his motorcycle in front of her house on 25.06.2025 at 7.00 A.M., on objection, petitioner abused her husband and brother-in-law and left threatening, after sometime, the petitioner along with named accused persons came and acted and acted inappropriately with her, thereafter petitioner assaulted her husband by an iron rod causing injury on head, further Dhanji and Gora assaulted her

Patna High Court CR. MISC. No.67311 of 2025(2) dt.09-10-2025 2/3 brother-in-law by lathi causing injury on hand, head and forehead, further Pintu and Ravi took away a 2 H.P motor and Manish snatched her Mangalsutra.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from side of the petitioner Tarari P.S. Case No.118/2025 was instituted by his grandmother against informant and her side. It is next submitted that on account of dispute relating to parking, an altercation had taken place in which both side had assaulted each other. It is also submitted that no doubt the petitioner is alleged to have assaulted the husband of the informant by rod causing injury on head but then the blow was not repeated and the injury has been opined to be simple in nature and petitioner is not a criminal.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount
