JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 366 of the Indian Penal Code.

It is alleged that the informant took her wife to the doctor on 27.9.2012 but she went missing. The informant saw this petitioner talking to the victim. It is also claimed that the victim used to talk with the petitioner on phone. The informant subsequently went to the petitioner to inquire about the victim who informed that the victim will return in few days. It is submitted by the learned counsel for the petitioner that the victim went traceless on 27.9.2012 but the complaint was filed on 4.3.2013 which came to be registered as police case on

Patna High Court Cr.Misc. No.12434 of 2015 (2) dt.25-03-2015 2/2 3.7.2013. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the delayed lodging of the case and suspicious nature of accusation, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saran at Chapra in connection with Garkha P.S. Case No. 96 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
