The petitioner is languishing in custody since 31.12.2014 in a case registered for the offences punishable under Sections 395/412 and 120B of the Indian Penal Code. On information of bank dacoity, when more than five lakhs rupees were robbed, FIR was lodged against one Binod. Petitioner was not named in the FIR. His name sprang up during investigation on confession of the co-accused when the petitioner also confessed his guilt and admitted that from the robbed money he purchased a motorcycle in the name of Suresh Yadav.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.10515 of 2015 (02) dt.23-03-2015 2/2 petitioner that except the confession before police there is nothing against the petitioner. Neither there is any recovery from the petitioner nor the petitioner has been put on T.I.P. Though, petitioner is Nepali citizen but statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the fact that that the petitioner has not been put on TIP and has no criminal antecedent, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj (Simraha) P.S. Case No. 729 of 2014.

Both the bailors should be Indian citizen.
