2. The petitioner apprehends his arrest in a case registered for the offence under Sections 272, 273, 34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

3. Total 67.5 liters of illicit Nepali liquor has been recovered from paddy straw of Bashishth Singh.

4. Name of the petitioner transpired during course of investigation. No incriminating article has been recovered from the possession of this petitioner.

5. However, learned A.P.P. for the State vehemently opposed the prayer for anticipatory bail and submitted that petitioner has got three criminal antecedent of similar nature.

6. Considering the similar nature of criminal antecedent of petitioner, the prayer for anticipatory bail of petitioner is rejected.
