The sole petitioner, apprehending her arrest in Sikta P.S. Case No.32/2017, registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail, in the event of her arrest or surrender. It was submitted by learned counsel for the petitioner that the petitioner has been falsely made accused. He submits that story has been cooked up by the Sub-Inspector of police (informant of the present case) that after seeing the police, the petitioner threw her bag, from which seven bottles of Indian Make Foreign liquor was recovered. A plea was taken by the
Patna High Court Cr.Misc. No.25398 of 2017 (2) dt.13-07-2017 2/2 informant that since there was no lady constable, the petitioner was not apprehended.
Considering the nature of accusation and improbable story, the Court is of the opinion that it is a fit case for extending the privilege of anticipatory bail. Let petitioner, namely, Haseena Khatoon , in the event of her arrest or surrender within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand ) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge, VIth, Bettiah( West Champaran) in connection with Sikta P.S. Case No.32 /2017, subject to condition as laid down in Section 438(2) of the Code of Criminal Procedure. (Rakesh Kumar, J) NKS/- U T
