2. The petitioner has renewed his prayer for anticipatory bail apprehending his arrest in a case registered for the offence punishable under sections 191(2), 191(3), 190, 126(2), 115(2), 109, 303(2), 74, 352, 351(2) of the B.N.S. which was earlier rejected vide order dated 04.08.2025.
3. It has been submitted by learned counsel for the petitioner that the specific allegation against this petitioner is that he has assaulted with kudal on the head of Ashia. It has further been submitted by learned counsel for the petitioner that Annexure-5 is the injury report of the injured, which goes to
Patna High Court CR. MISC. No.63947 of 2025(2) dt.12-09-2025 2/2 show that the injured has received one incised wound about 3 cm x 0.5 cm and sdr over right parietal occipital region. Learned counsel for the petitioner has also submitted that the opinion regarding the nature of injury was reserved. Now, the supplementary report of above injured is available and according the supplementary injury report, the nature of injury is simple. This is the changed circumstance under which, subsequent anticipatory bail is maintainable.
4. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Mahalgaon P.S. Case No. 74 of 2025, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria subject to the conditions as laid down under section 482(2) of B.N.S.S. (Ashok Kumar Pandey, J) Shubham/- U T
