The petitioners apprehend their arrest in connection with Nawada P.S. Case No. 651 of 2019 registered under Sections 341, 323, 325, 504, 506 and 307 of the Indian Penal Code. The accusation is that petitioners along with Sanni Kumar having iron rod, lathi and stick in their hand came at the door of the informant, Sudhir Prasad and started to abuse. When the informant made protest then both petitioners gave lathi blow at his head. Thereafter, Sanni Kumar and Ravindra Singh (petitioner no.1) gave lathi blow causing fracture injury at his hand. Learned counsel for the petitioners submits that due to land dispute occurrence took place, in which, petitioners' side also

Patna High Court CR. MISC. No.61340 of 2019(2) dt.15-10-2019 2/2 sustained injury, regarding which, Nawada Town P.S. Case No. 647 of 2019 is also instituted on the basis of written report of wife of petitioner no. 1. Moreover, two head injuries as found on the person of the informant are simple in nature whereas injury as found on the hand of the informant is said to be grievous in nature. It is further submitted that co-accused, Sanni Kumar has already been granted privilege of pre-arrest bail by a Bench of this Court vide order dated 28.08.2019 passed in Criminal Misc. No. 54245 of 2019.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada, in connection with Nawada Town P.S. Case No. 651 of 2019 , subject to the condition as laid down under Section 438(2) of the Cr.P.C.
