JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-05-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Jakkanpur Police Station Case No. 252 of 2014 registered for the offences punishable under Section 384 and 307 of the Indian Penal Code.
There is specific allegation against the petitioner that he opened fire causing firearm injury, I am not inclined to grant privilege of anticipatory bail to the petitioner, accordingly, his prayer for anticipatory bail in connection with Jakkanpur Police Station Case No. 252 of 2014, pending in the court of Judicial Magistrate, 1st class, Patna stands rejected. However, if petitioner surrenders and seeks regular bail
Patna High Court Cr.Misc. No.11730 of 2015 (3) dt.19-05-2015 2/2 within four weeks from today the concerned court shall consider regular bail application of the petitioner on its own merit without being prejudice by this rejection order particularly keeping in mind the nature of injury sustained by the informant as well as this aspect of the matter that prior to institution of the present case, the petitioner had filed a Miscellaneous case against the officials of Jakkanpur police station.
