The issued raised in the present writ application is no more res integra. The issue was decided on 31.03.2011 by a Coordinate Bench of this Court in the case of Ram Ashish Tiwary & Ors Vs. the State of Bihar & Ors (C.W.J.C. No. 6139 of 2007). The decision of the learned Single Judge was upheld in L.P.A. by the L.P.A. Court and even the S.L.P. against the decision of the L.P.A. Court was also dismissed.

Patna High Court CWJC No.18191 of 2019(2) dt.05-09-2019 2/2 Considering the aforesaid, the respondents are directed to consider the case of the petitioner in the light of the judgment of this Court in the case of Ram Ashish Tiwary & Ors Vs. the State of Bihar & Ors (C.W.J.C. No. 6139 of 2007), which was approved in L.P.A.

Necessary decision for grant of benefit in light of the judgment of Ram Ashish Tiwary & Ors (supra) may be taken by the respondents within a maximum period of 60 days from the date of receipt/production of a copy of this order. With the aforesaid, the writ application stands disposed of.
