JUSTICE AMARESH KUMAR LAL ORAL ORDER 08-05-2015 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 149, 365 of the Indian Penal Code, Section 17 of Criminal Law Amendment Act and Sections 13, 16, 18, 20 of U.A.P Act.
The allegation is that 23 named accused including the petitioner and 50-60 unknown persons of the M.C.C. terrorist group kidnapped three villagers and later on, they were released and also stopped the construction work of bridge and putting of JCB and other construction machine on fire.
It is submitted that the petitioner has been falsely implicated in this case and other cases of similar nature as the petitioner had dared to institute complaint case no.74/2005 against the police official of Imamganj police station in which cognizance
Patna High Court Cr.Misc. No.11410 of 2015 (2) dt.08-05-2015 2/2 was taken against him. It is further submitted that in similar facts and circumstances, the co-accused have been granted bail by the court below.
Considering the facts and circumstances of the case, let the above-named petitioner be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Gaya in Roshanganj P.S. Case No.59/2011 (U.A.P Trial No.17/15) with the following conditions :

One of the bailors will be the close relative of the petitioner.
2.
The petitioner will not indulge in similar or in any other offence.
3.
The petitioner will be well represented in the court.
4.
In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
