JUSTICE SHAILENDRA SINGH ORAL ORDER 20-11-2024 Heard Mr. Aryan Singh, learned counsel for the petitioners, Mr. Anant Kumar No.1, learned APP for the State and Mr. Avinash Kumar Singh, learned counsel for the informant.
2. Petitioners seek regular bail in connection with Mohanpur P.S. Case No. 76/ 2024 dated 11.05.2024 registered for the offence(s) punishable under Section(s) 344, 406, 420, 467, 468, 471, 120B and 506 of the I.P.C.
3. The main submissions advanced by learned counsel for the petitioners are that all the allegations levelled in the F.I.R. are totally false, in fact, the informant himself approached the petitioner No.2 for purchase of cosmetic products by
Patna High Court CR. MISC. No.68089 of 2024(3) dt.20-11-2024 2/3 sending e-mail on 22.11.2023 and showed his interest to purchase the products worth Rs. 1,85,000/- and thereafter the required cosmetic products were delivered to the said petitioner through courier service and in respect of business transaction, particularly, with regard to the terms and conditions, communication between the petitioner No.2 and the informant was made through e-mail of which hard copy has been filed as Annexure-P/2 series. It is further submitted that petitioners have been languishing in jail since 17.05.2024 and against them investigation has been completed.
4. Though learned counsel for the informant has opposed the bail prayer of the petitioners but has not made any submission in rebuttal of the above mentioned e-mail communication in between the petitioner No.2 and the informant.
5. Considering the above submissions as well as the facts and circumstances of this case and custody period of the petitioners coupled with the completion of investigation against them, this court is inclined to accept the bail prayer of the petitioners. Accordingly, let the petitioners named-above be released on bail in connection with Mohannpur P.S. Case No. 76 of 2024 on furnishing bail bond of Rs. 20,000/-(Twenty
Patna High Court CR. MISC. No.68089 of 2024(3) dt.20-11-2024 3/3 Thousand) each with two sureties of the like amount each to the satisfaction of the Court concerned.
