The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 307, 323 and other allied sections of the Indian Penal Code. As per the prosecution case, this petitioner came in inebriated condition and assaulted the informant on his head by means of lathi.

It is submitted that both parties are close relatives. Informant is own cousin brother of the petitioner and due to some family dispute the alleged occurrence took place. The doctor has found the injury attributed to this petitioner simple in nature. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner above-

No.63678 of 2022(2) dt.11-04-2023 2/2 named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Koilwar P.S. Case No. 273 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
