The petitioner is in custody in connection with Asarganj P.S. Case No. 8 of 2017 registered for the offences punishable under sections 384 and 386 of the Indian Penal Code. The FIR was lodged against unknown. The name of the petitioner was disclosed by co-accused Pinku Upadhyay in this case in his confessional statement.
Learned counsel for the petitioner submits that ransom amount of Rs. 5,00,000/- was demanded on mobile no. 9931204279 from mobile no. 7654591030 which has been mentioned in paragraph 4 of this petition and the petitioner in paragraph 7 of this petition, has denied that he has neither any
Patna High Court Cr.Misc. No.26997 of 2017 (3) dt.06-07-2017 2/2 connection with the co-accused Pinku Upadhyay nor in any way connected with mobile no. 7654591030, which was allegedly used for ransom and the case was registered against unknown and the petitioner's name was disclosed by co-accused Pinku Upadhyay in his confessional statement and there is no other material except suspicion of his involvement in this case and the petitioner is in jail since 8.2.2017.
Considering the facts and circumstances of the case, I am inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri N.K. Dubey, Judicial Magistrate 1st class, Munger or Successor Court in connection with Asarganj P.S. Case No. 8 of 2017, subject to the condition that the petitioner will extend full cooperation in conclusion of the trial and he will not, in any manner, tamper with the evidence and influence the witnesses.
