For the Petitioner/s : Mr. Sudish Kumar For the Opposite Party/s : Mr. Rajeev Nayan ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 12-06-2017 Heard the learned counsel for the petitioner and the learned counsel for the State.
The instant application has been filed for grant of regular bail in connection with Giriyak (Katrisarai) P.S. Case No. 101 of 2017, registered for the offence under Sections 419,420,467,468 and 471 of the India Penal Code. The allegation against the petitioner is with regard to opening of the account in the name of Ajay Singh on the basis of forged documents. It has been further alleged that when the customer was called on his mobile number, the petitioner came to the Bank and confessed that he had opened the account on the basis of forged documents, however, the petitioner is said to have opened the account wherein the balance was of Rs. 3351/-. It appears from the order dated 27.04.2017 passed by
Patna High Court Cr.Misc. No.26448 of 2017 (2) dt.12-06-2017 2/2 the learned trial Court in B.P. No. 488 of 2017 that the petitioner has been granted liberty to renew his prayer for bail after six months from the date of custody, if trial is not concluded. Having regard to the facts and circumstances of the case, I find that since the petitioner is in jail since 28.03.2017 as well as the petitioner has a clean antecedent, there is no impediment for granting regular bail to the petitioner. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda at Bihar Sharif in connection with Giriyak (Katrisarai) P.S. Case No. 101 of 2017.
