Petitioner is accused in connection with Rajgir P.S. Case No. 169 of 2015 registered under Section 363 of the I.P.C. and later on, sections 396 and 34 of the I.P.C. was added. Submission of learned counsel for the petitioner is that petitioner is not named in the F.I.R. In course of investigation, dead body of Sajan Kumar was recovered from mountain of Rajgir. Thereafter, the Police got recorded the confessional statement of co-accused Murari Rajbanshi @ Mushari Rajbanshi, as detailed in paragraph no. 121 of the case diary, who confessed his guilt and showing involvement of petitioner in the murder of the deceased. Except the confessional statement of co-accused, there is nothing against the petitioner. Further submission is that

Patna High Court Cr.Misc. No.9540 of 2016 (3) dt.29-04-2016 2/2 co-accused Murari Rajbanshi, who disclosed the name of the petitioner, has already been allowed bail by a Bench of this Court vide Cr. Misc. No. 14078 of 2016 on 05.04.2016. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. 4th Nalanda at Biharsharif in connection with Rajgir P.S. Case No. 169 of 2015.
