The petitioner is apprehending his arrest in connection with Fatuha P.S. Case No. 256 of 2015 for the offences instituted under Sections 304(B)/34 of the IPC.
The accusation is of killing the daughter of the informant by the accused persons for non-fulfilment of dowry demand. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner has been made accused in the present case due to mistake of fact. The death of the deceased is said to be a natural death. On behalf of the learned counsels for the informant and
Patna High Court Cr.Misc. No.10910 of 2016 (2) dt.25-04-2016 2/2 the State it has been submitted that the petitioner is named in the F.I.R. and he is the husband of the deceased. Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner. The same is rejected in Fatuha P.S. Case No. 256/2015, pending in the court of the learned J.M. Patna City. Anyhow, if the petitioner surrenders in the court below the same shall be considered on its own merit without being prejudiced by this order.
