Petitioner is languishing in custody since 06.01.2017 in connection with Panjawara P.S. Case No. 04 of 2016 for the offences alleged under Section 395/397 of the Indian Penal Code. The prosecution case, as lodged by the informant, is that while he was returning on his vehicle, 5-6 un-known persons intercepted him and took away his money and mobile. It has been submitted by the learned counsel for the petitioner that petitioner is not named in the F.I.R. and was apprehended in another case and remanded in the present case on 06.01.2017. He submits that nothing incriminating article has been

However, learned A.P.P. submits that petitioner has criminal antecedent.

Considering the facts and circumstances and the materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Banka in connection with Panjwara P.S. Case No. 04 of 2016 subject to the condition that since the two cases of similar offence are pending against the petitioner, if the petitioner indulges in an offence of similar nature, the learned court below will be at liberty to cancel the bail bonds of the petitioner.
