The petitioner seeks regular bail in connection with Fatehpur P.S. Case No. 324 of 2016 and S.Tr. No. 48/2018, registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307 of the Indian Penal Code and later on added section 302/34 of the Indian Penal Code. Allegation against the petitioner is of assault on the head of the deceased by Chapara, causing his death. Learned counsel for the petitioner submits that the petitioner is in custody since 06.07.2017 and there is no chance of tampering with the evidence.

Perused the report submitted by the learned trial

Patna High Court CR. MISC. No. 58525 of 2019(4) dt.06-02-2020 2/2 court it appears that altogether six witnesses have been examined, cross-examined and discharged out of total 11 charge sheeted witness.

Considering that the trial is at advance stage, I am not inclined to enlarge the petitioner on bail. This application is accordingly dismissed.

However, the court below is directed to expedite the trial and conduct it on regular basis so that trial be concluded within a period of six months.
