The petitioner apprehends his arrest in connection with Saraiya P.S. Case no. 26 of 2004, registered under Sections 147, 148, 149, 341, 323, 379, 427 and 504 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that in the evening of 25.02.2004 the informant being the Mukhiya was talking to the villagers. At that time Manoj Singh along with some unknown came and started abusing him and laid him on the ground and golden chain, wrist watch and cash of Rs. 5000/- of the informant was also snatched. On interference of the villagers, informant was set free. The miscreants also looted articles of the shops situated there.

Learned counsel for the petitioner submits that petitioner

Patna High Court Cr.Misc. No.26065 of 2017 (5) dt.08-09-2017 2/2 is not named in the F.I.R. Further submission is that, in fact, the petitioner is resident of Chhitari Chowk, which is the place of occurrence and due to grudge and enmity his name has been disclosed by some witnesses. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, West Muzaffarpur in connection with Saraiya P.S. Case No. 26 of 2004, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
