Heard learned counsel for the petitioner, learned Addl. Public Prosecutor for the State as well as learned counsel for the informant.
Petitioner seeks bail in a case registered under section 307 and other allied sections of the Indian Penal Code as well as section 27 of the Arms Act.
The controversy raised in respect of criminal antecedent of the petitioner by learned counsel for the informant is properly replied on behalf of the petitioner in his supplementary affidavit. So far as accusation against the petitioner is concerned, it is stated that the petitioner along with some others assaulted the informant and one Sumit Kumar Ojha but annexure 3 to the
Patna High Court Cr.Misc. No.11822 of 2016 (2) dt.17-03-2016 supplementary affidavit shows that both injured sustained simple injury, though injury of one of the injured is said to have been caused by sharp cutting weapon.
Moreover, having more or less similar allegation coaccused Satish Kumar Singh and two others have already been granted privilege of bail by a coordinate bench of this court. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in Marhowrah P.S.
