JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 07-07-2017 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel representing the State.

The petitioner apprehends his arrest in connection with Mahila (Sasaram) P.S. Case No. 28 of 2017, registered for the offences punishable under Sections 354, 341, 323, 504, 506/34 of the Indian Penal Code.

Allegedly, the petitioner and other co-accused started assaulting Navin Kumar Sinha (bhaisur of the informant) and when the informant intervened into the matter, three accused persons pushed her, resulting, she fell down on the ground and they tried to outrage her modesty and further they assaulted on head, hand, stomach and leg with lathi and when Prithivi Paswan came to rescue then he was also assaulted by them and further they caused threats to kill the husband and children of the

Submission is of false implication and that no injury has been caused as alleged, the petitioner has filed petition under Section 39 of the Cr.P.C. in the Court of C.J.M., Rohtas, Sasaram on 03.06.2016, being annoyed the petitioner has filed this case on 05.05.2017. The petitioner is an Advocate and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. duly assisted by the learned counsel for the informant opposes the prayer of pre-arrest bail by submitting that the petitioner and his sons have tried to outrage the modesty of the informant also besides assault. In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs.

10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Rohtas, in connection with Sasaram Mahila P.S. Case No. 28 of 2017, subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.)
