====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-05-2023 Heard learned counsels for the petitioner and the State.
Petitioner apprehends arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 337, 338, 307, 333, 353, 328 and 504 of the Indian Penal Code. Owing to the road accident, claiming life of one person, people around 200-300 blocked the road, raised antipolice slogan, ran riot and pelted stones and also attacked on the informant and police personnel making them injured. Petitioner is said to be member of the mob.
Learned counsel appearing for the petitioner submits that the petitioner has no concern with the aforesaid occurrence. He has falsely been implicated in this case. Allegation levelled against the petitioner is not specific rather general and omnibus
Patna High Court CR. MISC. No.62027 of 2022(3) dt.01-05-2023 2/2 in nature. No injury report of any of the injured has been brought on record. It is further submitted that similarly situated co-accused persons have already been granted anticipatory bail by co-ordinate Benches of this Court vide Annexure - 2 (Series).
Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P. S. Case No. 204 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
