2. The petitioner is named in the F.I.R. and apprehending his arrest in connection with Sheikhpura (Mahila) P.S. Case No. 38 of 2023 registered for the offences punishable under Sections 498A, 504 and 34 of IPC and Section 3⁄4 of D.P. Act.
3. The allegation against petitioner is to commit mental and physical cruelty upon informant due to non-fulfillment of demand of dowry as raised for cash of Rs. 5 lakhs and also advancing threat to solemnize another marriage. It was further alleged that informant came to know that petitioner solemnized his marriage with another girl (without disclosing her name).
4. It is submitted by learned counsel appearing on

No.65358 of 2023(3) dt.27-01-2026 2/3 behalf of the petitioner that allegation qua mental and physical cruelty is appearing very much general and omnibus in nature and same can be gathered from the FIR itself, as petitioner was in talking terms with a girl. It was alleged that allegation of second marriage with unknown girl without specifying any details is completely unfounded just to aggravate the allegation.

Learned APP duly assisted by learned counsel for the informant while opposing the prayer of bail submitted that allegation of demand of dowry is available against petitioner and as per FIR he solemnized second marriage subsisting his first marriage with informant. However, it is submitted that informant is ready for compromise.

In view of aforesaid factual submission and by taking note of fact as prima-facie allegation qua committing physical and mental cruelty is appearing very much general and omnibus in nature, accordingly petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Sheikhpura/concerned Court, where the case is pending in connection with Sheikhpura( Mahila) P.S. Case No. 38 of 2023,
Patna High Court CR. MISC. No.65358 of 2023(3) dt.27-01-2026 3/3 subject to the conditions as laid down under Section 438(2) of the Cr.P.C/ Section 482(2) of BNSS.
7. Parties are free to enter into compromise at any stage of trial before learned trial court.
