JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2020 Petitioners seek bail in connection with Vijayipur P.S. Case No. 169 of 2017, registered for the offences punishable under Sections 302 and 120B of the Indian Penal Code. Earlier prayer for bail of the petitioners was rejected by the then co-ordinate Bench of this Court by order dated 20.2.2018 passed in Cr. Misc.No. 5755 of 2018 and again by order dated 9.1.2019 passed in Cr. Misc. No. 78760 of 2018. The ground for grant of bail is that there is delay in conclusion of trial.

Heard learned APP and perused the report of learned trial court, from which it appears that nine witnesses have been examined and thereafter a petition has been filed by defence for

Patna High Court CR. MISC. No.59860 of 2019(3) dt.31-01-2020 2/2 recalling of Doctor for cross-examination, as such the matter has been lingering and trial court assures to conclude the trial soon. In view of above facts and circumstances, I am not inclined to grant bail to the petitioners.

Accordingly, this application is dismissed.
