The petitioner seeks regular bail in connection with Sirdalla P.S. Case No. 44 of 2017, registered under Section 30(A) of Bihar Prohibition of Excise Act, 2016.
The allegation leveled against the petitioner is with regard to the police receiving secret information regarding illicit liquor being transported by the petitioner. It is further alleged that the police had seized about 29 litres of foreign liquor from the place of occurrence.
Learned counsel for the petitioner submits that the petitioner is innocent, has no criminal antecedent and he is in custody since 26.03.2017. He has further submitted that the
Patna High Court Cr.Misc. No.26549 of 2017 (2) dt.13-06-2017 2/2 petitioner has not been apprehended from the place of occurrence. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -Vth, Nawada, in connection with Sirdalla P.S. Case No. 44 of 2017.
