2. The petitioner apprehends her arrest for the offences alleged under Section 406 of the Indian Penal Code registered in connection with Lalganj P.S. Case No. 19 of 2009/G.R. No. 343 of 2009.
3. It is submitted that the petitioner has been falsely implicated being the Secretary of the school in question. The money for construction of boundary wall of the School was withdrawn by joint signature of the informant Headmaster as well as the petitioner, but it was the informant who had taken the withdrawn amount who failed to complete the work. It is stated that in course of investigation the informant Headmaster has also been made accused in this case for misappropriation of public money.
4. Having regard to the entirety of the facts and circumstances, in the event of the petitioner's arrest or surrender before
Patna High Court Cr.Misc. No.12167 of 2016 (2) dt.16-03-2016 the court below within six weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Ms. Niharika, learned J. M. Ist Class, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 19 of 2009/G.R. No. 343 of 2009, subject to the conditions as laid down under Section 438 (2) Cr.P.C., and also subject to the following further conditions: (i) The petitioner shall cooperate with the investigation and make herself available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail. (ii) The petitioner will be well represented on each and every date and if she fails to do so on two consecutive dates, her bail bond will be liable to be cancelled by the Court concerned.
