JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 07-07-2017 Heard learned counsel for the petitioner. No one appears on behalf of the State to assist the Court. The petitioner is in custody in connection with Muffasil P.S. Case No. 93 of 2013 for the offences under Sections 147, 148, 149, 341, 323, 307, 337, 338, 332, 333, 353, 379, 411 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner is in custody since 27.3.2017. It is submitted on behalf of the petitioner that he was one of the members of mob which assembled to protest the death of one Chhotu Kumar in accident at NH 82. The case was registered at the instance of the Block Development Officer, Manpur, Gaya.
In para-3 the petitioner has stated on affidavit
Patna High Court Cr.Misc. No.27578 of 2017 (4) dt.07-07-2017 2/2 that he has no criminal antecedent. In para-8 it has been stated that co-accused Naresh Prasad has been granted bail on 9.3.2013 by learned ADJ-IV, Gaya vide B.P. No. 111/2013, Co-accused Birendra Kumar has also been granted bail by the court below in B.P. No. 86 of 2013 vide order dated 1.4.2013 by ADJ-IV, Gaya and co-accused Nato Yadav has been granted bail by this Court in Cr. Misc. No. 22253/2017 vide order dated 17.5.2017. Considering the fact that the petitioner is in custody since 27.3.2017, he has no criminal antecedent and the fact that similarly circumstances other member of the mob have been granted bail by the Court below as well as this Court, as mentioned above, let the petitioner, above named be enlarged on bail on furnishing bail bond of Rs.
10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya or the successor Court in connection with Mufassil P.S. Case No. 93 of 2013, subject to the condition that the petitioner will extend full cooperation in conclusion of the trial and will not, in any manner, tamper with the evidence and influence the witnesses.
