The first information report was registered on basis of a statement made by the village Chaukidar, inter alia, alleging that he had heard that on the previous day Nanda Manjhi came in contact with live wire hanging low illegally put up to tap electricity for irrigation by the petitioner and died. He was surreptitiously cremated.

Case diary was called for to ascertain whether parents or relatives of Nanda Manjhi had complained and whether or not they knew about the death and cremation. Learned APP frankly

Patna High Court Cr.Misc. No.14889 of 2015 (4) dt.10-06-2015 submits that there has been no investigation at all on these issues and there is no statement of the relatives making any such complaint.

Be that as it may, in the event of his arrest or surrender within four weeks from today, the petitioner abovenamed shall be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in Magadh Medical PS Case No 110 of 2014 subject to all conditions as laid down in Section 438 (2) of Criminal Procedure Code.
