JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-01-2024 The present writ petition has been filed seeking the following reliefs:- "1.(i) For issuance of Last Pay Certificate (L.P.C.) of the petitioner from Mithila Range of the Department of Police, Darbhanga to the Mithila Range of the Department of Police at Madhubani as the petitioner was posted as SubInspector of Police at Darbhanga from 02.11.2007 to 25.10.2008 and thereafter he was transferred from Darbhanga to Madhubani where he remained posted from 29.08.2010 to

2/4 01.05.2012 working on the post of SubInspector of Police but till date the Last Pay Certificate (L.P.C.) of the petitioner has not been issued by the concerned authority of Mithila Range of the Department of Police at Darbhanga to the authorities of petitioner's transferred place at Mithila Range of Department of Police of Madhubani causing the nonpayment of petitioner's salary since his date of posting at Mithila Range, Madhubani i.e. since 29.08.2010 up to now as presently the petitioner is discharging his duties on the post of Inspector of Police at Bhabhua, Kaimur.

(ii) Also for directing the respondent authorities for making payment of the arrears of petitioner's monthly salary which remained due to be paid to the petitioner since 29.08.2010 to till date on account of non-issuance of his Last Pay Certificate (L.P.C.) without any valid rhyme and reason for non-issuance of the same with statutory interest calculating it from the date since when it remained due to be paid i.e. from its actual date of payment and thereby to continue making payment of petitioner's salary."

This Court on going through the records of the case finds that the petitioner is not getting salary since more than 10 years on account of nonresolution of the issue regarding grant of Last Pay Certificate to the petitioner, which may be on account of the petitioner not handing over the charge of U.D. Case No. 01 of 2009, while he was posted at Ghanshyampur Police Station under Darbhanga District as also not submitting 'No Objection Certificate', however, the same could not have detained the authorities from resolving the matter at their end and non-resolution of the same during the past 10 years shows gross laches on the part of the respondent-authorities. Nonetheless, the learned counsel for the respondent-State submits that the issue in question shall be resolved and admitted outstanding amount of salary, shall be paid to the petitioner, within a period of four weeks from today. It is directed accordingly. 3.

It is needless to state that the Director General of Police, Bihar, Patna shall ensure compliance of the aforesaid order of this Court.
