JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 10-05-2016 Heard the counsel for the petitioner and the State. The petitioner herein seeks anticipatory bail in Raja Pakar P.S. Case No. 34 of 2014 registered under Sections 406, 409, 420, 120(B)/34 of the Indian Penal Code. It is stated that under certain programme/project twelve solar lights of specific make with supporting service was required to be installed in the Gram Panchayat. The accused(s) connived together and installed solar lights of inferior quality. In this background, the Block Development Officer lodged the case against the petitioner and other.

It is stated that petitioner is only an employee of the local supplier who was granted anticipatory bail vide order at Annexure-2.

No.17365 of 2016 (2) dt.10-05-2016 2/2 In the facts and circumstances of the case, let the petitioner above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Vaishali at Hajipur in Raja Pakar P.S. Case No. 34 of 2014 on condition that one of the bailors shall be his own/close family member. The petitioner shall appear on each date fixed at the trial. In case of default in appearance on two consecutive dates, the trial court shall have liberty to cancel his bail bonds.
